Enugu State Governor Peter Mbah today failed to appear before the Governorship Election Petition Tribunal, after he was served a subpoena through his lawyer.
The subpoena was served following an application by counsel to the People’s Redemption Party, PRP, Alex Amujiogo challenging the absence of the governor from court in a case of alleged certificate forgery.
Amujiogo who berated the governor for dishonoring the subpoena, stated that the court session was his last opportunity to close his case, while appealing to the court to come to his aid.
However, the lead counsel to the Peoples Democratic Party, PDP, Anthony Ani (SAN) argued that the governor was ready to appear before the court, but the service of the subpoena did not comply with the provisions of the law.
Earlier, Justice K. M. Akano had ordered that the subpoena be served on Mbah through his counsel and that he should appear before the Tribunal today, which he failed to honor.
Justice K. M. Akano adjourned the case till tomorrow, for the Independent National Electoral Commission to open its defence.
